Request for investigation into ACRCD’s management of Sunol AgPark and Treatment of Solo Female Farmers

I am writing to request that you open an investigation into the Alameda County Resource Conservation District (ACRCD), which is currently leasing the Sunol AgPark property from the San Francisco Public Utilities Commission (SFPUC). 

As a former farmer on a land license at the AgPark, I believe I have faced harassment, discrimination, and retaliation due to the gross mismanagement of the AgPark by ACRCD, ultimately leading to the loss of my farming operation and career.

The AgPark was intended to be a community resource managed by a public agency, and as such, it should not be used to harass and discriminate against the very people it is meant to support and serve. 

Although I understand that ACRCD is a Special District and SFPUC is the landowner who is not involved in its operation of the AgPark, I specifically request that the SFPUC Commission and Office of BOS District 1 investigate how the AgPark treats solo female farmers.

I have been attempting to obtain California Public Records Act (CPRA) reports from ACRCD, but they have been exceedingly slow in providing them, sending only a dozen or so emails every month since December 2023. 

I suspect these delays are deliberate and aim to frustrate my efforts to uncover the truth. Moreover, ACRCD has refused to hold in-person meetings or mediations when they decided not to renew my license, further demonstrating their lack of transparency and unwillingness to engage in constructive dialogue.

During my decade-long tenancy at the AgPark, there were only three farming operations solely run by females, including myself. Alarmingly, all of them have since departed the AgPark. This disturbing pattern raises serious concerns about the management and oversight of the AgPark, and I believe it warrants a thorough investigation to ensure that the AgPark is operating in a fair, equitable, and non-discriminatory manner.

The three of us who came in the same cohort were: Kristyn Leach(Namu Farm), Joanna Letz(Bluma Farm) and myself, Lalitha Visveswaran(Jellicles Farm). The conditions were so hostile and unsustainable that today, there are no solo female farm operators remaining at the AgPark. This is a stark and troubling reality that demands immediate attention and action.

Furthermore, I believe the other two female farmers were given assistance and time to relocate and settle in their new operations, which I was never offered, despite my requests for mediation.This disparate treatment has effectively ended my entire 12-year farming career, as I have no other appropriate land to farm and am now facing financial ruin due to my investments. As an immigrant who started a farming career in a new country in my 40s, this is utterly devastating and has far-reaching consequences for my livelihood and well-being.

It is particularly egregious that I faced harassment and discrimination during my medical recuperation period, when I was most vulnerable. While I am pursuing this matter with ACRCD and collecting evidence, their delayed responses seem premeditated to make me abandon my fight for justice. This is unacceptable and goes against the very principles of fairness and accountability that public agencies are expected to uphold.


Moreover, I believe that a comprehensive CPRA request for all records, including emails and minutes of meetings between the farmers, ACRCD staff, and within ACRCD, would paint a clear picture of how ACRCD managed the AgPark. I am particularly concerned about the apparent disparate treatment between male-run and female-run farms. 


It appears that more serious issues and flagrant disregard for the farm policy and rules of the AgPark from the male-run farms were often disregarded or dismissed with a small monetary fine or a probationary period. The evidence for this discrepancy can likely be found in the emails and minutes of the meetings. This further underscores the need for a thorough investigation into ACRCD's management practices and their potential discriminatory behavior.


As an immigrant and first-generation American, I feel that I have been unfairly targeted and discriminated against, despite being a law-abiding, rule-following, tax-paying citizen in Alameda County. The lack of support and the disparate treatment I have received from ACRCD is deeply troubling and raises questions about their commitment to equality and fairness.


As an immigrant without established community ties, networks, and connections, I should not be subjected to exploitation or discrimination by public agencies like ACRCD, which are entrusted with serving and supporting all members of the community equally.


Given these circumstances, I urge SFPUC to reconsider the competency of ACRCD in managing this public community resource and to thoroughly investigate their treatment of solo female farm operators at the Sunol AgPark. 

As my own investigations are being obstructed, I request that SFPUC and the Board of Supervisors for Alameda County District 1conduct a comprehensive investigation and assist me in my quest for justice. The public deserves to know the truth about how the AgPark is being managed and whether it is fulfilling its intended purpose of serving the community.

Thank you for your attention to this critical matter. I humbly request your assistance in my quest for justice, as it would mean a great deal to me personally and serve as a powerful example of how public agencies should operate and how female farmers, especially those from diverse backgrounds, should be supported and empowered.

I am writing to present evidence that further underscores my concerns about the Alameda County Resource Conservation District’s (ACRCD) management of Sunol AgPark, particularly regarding the handling of my farming license.

Enclosed are critical screenshots from internal ACRCD communications obtained from a partial CPRA request, which I believe illustrate a premeditated decision to not renew my farming license, contrary to the ongoing dispute resolution process.

One of these screenshots, dated August 23,explicitly indicates that the decision not to renew my license had already been made, despite ongoing discussions and dispute resolution efforts. 

This revelation is particularly concerning as it suggests that the dispute resolution process was merely a facade, with no real intent of addressing or resolving the issues raised.

Moreover, these actions by ACRCD were taken during a period when I was in medical recuperation, exploiting my situation and imposing demands that were beyond my capacity to fulfill at the time. This constitutes a clear case of harassment, utilizing my medical condition as leverage against me.

I also wish to highlight that, during this period, ACRCD engaged legal counsel, incurring expenses that were potentially passed on to SFPUC. 

It should be of concern that SFPUC resources were utilized under the guise of a fair dispute resolution process, which, as the evidence suggests, was never intended to be impartial or just.

In light of these circumstances, I urge the SFPUC and the Alameda County Board of Supervisors to conduct an independent investigation into these practices. 

The enclosed screenshots are merely indicative of the broader issues at play, and a thorough investigation is necessary to uncover the full extent of ACRCD’s actions.

I seek not only clarity and accountability but also justice and restitution for the losses and hardships I have endured due to these actions. 

It is my belief that only through an independent inquiry can the truth of these matters be fully understood, and appropriate actions be taken to rectify the wrongs committed.

Recent California Public Records Act (CPRA) request findings have uncovered that ACRCD’s decision to not renew my farming license was predetermined as early as August 2023. This decision, made during my period of medical recuperation, appears to have been a calculated move, taken irrespective of my compliance with ACRCD’s requirements and ongoing dispute resolution efforts.

Such actions by ACRCD not only disregarded the principles of fair management but also leveraged my personal circumstances against me, exacerbating my vulnerability and leading to the termination of my decade-long farming career on SFPUC land.

This premeditated decision by ACRCD has significant implications for SFPUC, as it indicates a potential misuse of the resources and budget allocated for the administration and management of Sunol AgPark. 

Furthermore, it is concerning that ACRCD may have misled SFPUC by projecting an image of engaging in dispute resolution, while budget discussions and allocations for county counsel were ongoing with SFPUC, despite having already made the decision to terminate my license. 


This raises serious concerns about ACRCD’s commitment to transparency, ethical practices, and the welfare of the farming community it is supposed to support.

The impact of these actions on my personal and professional life has been profound. I have suffered considerable financial strain, emotional distress, and the loss of my decade long farming operation.

In light of these troubling revelations, I strongly urge the SFPUC to conduct a thorough investigation into ACRCD’s management practices at Sunol AgPark. 


It is crucial to assess whether ACRCD is acting in the best interest of the public, the land, and the farmers it serves, and to ensure that such misuse of authority and resources does not recur.

I am available to provide further information and evidence to support these claims and am seeking your assistance in obtaining justice and restitution for the hardships I have endured due to ACRCD’s conduct.

I am writing to you as a former licensed farmer at Sunol AgPark, managed by the Alameda County Resource Conservation District (ACRCD) under a lease with the San Francisco Public Utilities Commission (SFPUC). 


For the past ten years, I have diligently worked at Sunol AgPark until my recent experience led to the non-renewal of my farming license, which I believe was influenced by discrimination and harassment following a period of medical leave post-surgery. 


Despite my efforts to communicate, resolve, and seek mediation with ACRCD, all attempts have been unsuccessful, culminating in the unfortunate termination of my farming career.

The partial California Public Records Act (CPRA) results I received from ACRCD seem to deliberately omit critical communication, particularly the letter(sent by email and USPS) I sent on October 20 2023, titled “Concerns for Future Retaliation, Evidence Request and Detailed Timeline.” 


This email, along with other correspondences, appears to have been actively suppressed or not acknowledged by ACRCD. Furthermore, certified mail(dated November 09, 2023) containing grievance details was unclaimed and returned, suggesting an intent to ignore significant correspondence.

Additionally, evidence from the CPRA discovery indicates inquiries about these suppressed emails and unacknowledged mail, yet the trail abruptly ends, implying an incomplete disclosure of records. 


This incomplete response and the absence of crucial text messages or meeting notes that led to the official emails and notices sent, raise serious questions about ACRCD's compliance with CPRA regulations.

The CPRA is designed to ensure transparency and accountability in public agencies. The inconsistencies and gaps in ACRCD’s response, coupled with the lack of disclosure of text messages and meeting notes, indicate a potential breach of these principles. 


The missing information is critical to understanding the context and decision-making process that led to the non-renewal of my farming license at Sunol AgPark.

Given these concerns, it is my hope that through this investigation, any wrongs can be righted, and a fair resolution can be found for the significant losses I have suffered. 


It is imperative to establish the full extent of the records pertaining to my communications with ACRCD and to ensure that all relevant and legally required information is disclosed. 


There seems to be an alleged intent by ACRCD to suppress communication and create a false narrative to justify the non-renewal of my license.

Your intervention in investigating these irregularities and ensuring full compliance with CPRA requirements is crucial.

As a resident of Alameda County and a former licensee of Sunol AgPark, I am deeply concerned about discrepancies and gaps in the CPRA records provided by ACRCD.

Despite not having legal representation, I have pursued CPRA requests to understand the full extent of communications pertaining to my case. 

However, the records I have received to date are incomplete and exclude key communications, including public meetings, minutes, text messages, and certain emails. 

For instance, an email I sent on October 20, 2023(Communication #6 in Timeline), seeking a meeting to present evidence of harassment and concerns of retaliation, is conspicuously absent.

These omissions hinder my ability to fully grasp the circumstances surrounding the non-renewal of my farming license and the alleged workplace harassment I faced during medical recuperation. With my CA incorporated farming business facing termination due to the lack of suitable farmland, time is of the essence. 

The delay in receiving complete CPRA records also jeopardizes my ability to file a timely complaint with the EEOC, as I am approaching the 180-day limit.

Furthermore, my attempts to communicate grievances directly with ACRCD have faced similar obstacles. A critical example of this is a grievance (Communication #8) letter I sent via USPS, which was unclaimed by ACRCD despite them having received a copy via email. 

It was only after the intervention from the Board of Supervisors that ACRCD acknowledged and addressed this grievance. This incident further illustrates the difficulties I have encountered in seeking fair and transparent communication from ACRCD.

Given these challenges, I am considering a fair settlement. However, without a comprehensive understanding of the events and actions taken by ACRCD and Sunol Agpark Committee, any decision on my part is significantly hampered.

Therefore, I respectfully request your office to initiate an investigation into ACRCD's handling of my case and their CPRA compliance. Your involvement is crucial for ensuring transparency and justice in this matter.

I am writing to file a formal complaint about the Alameda County Resource Conservation District (ACRCD) and their handling of a significant grievance matter pertaining to the unfair non-renewal of my farming license at Sunol AgPark.

Complaint Overview:


I recently sent a certified letter(dated Nov 9, 2023) to ACRCD, which contained a grievance about their conduct and decision-making process regarding the non-renewal of my farm license at Sunol AgPark. 


To my concern, this certified mail was unclaimed by ACRCD and returned to me(Jan 16, 2024), indicating a refusal to acknowledge or address my grievance.

Background of the Grievance Mail:


Before sending the certified mail, I had sent a copy of the grievance letter via email to ACRCD. 

Therefore, they were aware of its contents and the nature of the grievances it contained. The decision to not claim the certified letter, despite this prior knowledge, clearly implies a deliberatefailure on ACRCD’s part to formally acknowledge and address the grievance. 

This grievance was never acknowledged despite multiple email communications suggesting a rejection and disregard of due process. 

This is especially concerning given that all previous certified mails sent to ACRCD via USPShave been claimed and acknowledged.

Implications of ACRCD’s Actions:


1. Failure to Acknowledge Grievance: As a public agency and a leaseholder of the San Francisco Public Utilities Commission (SFPUC), ACRCD has a responsibility to responsibly manage and respond to grievances. Their failure to claim and acknowledge my certified mail raises serious concerns about their commitment to transparency and accountability.

2. Impact on My Rights: This action directly impacts my ability to seek fair resolution and justice, as my attempts to communicate and resolve this matter have been repeatedly ignored.

I am writing to you in your capacity as President of the Board of the Alameda County Resource Conservation District (ACRCD) to bring to your attention several concerns that have recently come to light following my review of records obtained through a partial California Public Records Act (CPRA) request for the year 2023.

After careful examination of these records, I have encountered discrepancies and issues surrounding the non-renewal of my farming license at Sunol AgPark, which I believe warrant a thorough investigation. The specific concerns include:

1. Misrepresentation and Discrepancies: Records suggest significant differences between the reasons communicated to me for the non-renewal of my contract and the internal discussions within ACRCD and Sunol AgPark management.

2. Health Condition Disclosure Misuse: My disclosed health condition and the challenges I faced as a female farmer, including my efforts to adapt to new farming equipment during the COVID-19 lockdown, appear to have been used against me in the evaluation process.

3. Contradictory Claims: The claim of my lack of engagement by the Agpark manager starkly contrasts with the extensive record of text message logs and interactions that I maintained, documenting my active involvement and communication.

4. Procedural Irregularities: The processes leading to the decision on my contract non-renewal seem to lack transparency and adherence to established procedures, raising concerns about procedural fairness.

In addition to the aforementioned concerns, there is also the matter of potential tortious interference with my contract. The actions and decisions that led to the non-renewal of my farming license seem to extend beyond standard administrative procedures.

I am concerned that these actions may constitute an intentional and wrongful interference in my contractual relationship with the ACRCD, which has not only resulted in the termination of my contract but also caused me considerable financial and emotional harm.

Given the severity of these implications, an investigation into possible tortious interference, alongside the other issues raised, is crucial to ensure that all aspects of my case are thoroughly and fairly examined.

These findings have led me to question the fairness and integrity of the decision-making process regarding my tenure at Sunol AgPark. The implications of these actions have been profoundly detrimental, leading to the termination of my decade-long farming career, financial hardship, and significant personal distress.

In light of these serious concerns, I respectfully request your intervention to conduct a comprehensive and impartial investigation into these matters. It is essential for the integrity of ACRCD that such issues are addressed transparently and justly.

I am seeking not only clarification and accountability but also justice and appropriate restitution for the hardships and losses incurred due to what appears to be unjust and potentially biased actions.

I am writing to seek your intervention and guidance regarding a series of troubling events involving the Alameda County Resource Conservation District (ACRCD) and the management of Sunol AgPark, which have culminated in the unwarranted termination of my decade-long farming career.

On June 7, 2023, I received a letter of violation of license terms from ACRCD that included demands, many of which I had already fulfilled prior to the date of receipt. 

Despite my efforts to comply and my communication about recuperating from a medical procedure, the demands escalated, some reaching the point of impossibility.

Throughout the year, my attempts to address these concerns were consistently disregarded. My grievance reports filed in response to these actions were never satisfactorily addressed.

Subsequently, on November 7, my license was non-renewed, despite my adherence to the stipulated terms in the letter of violation. 

Notably, my requests for mediation were denied, and recently, I discovered a unilateral contract modification in the farm policy I had signed, further complicating matters.

In addition to the procedural irregularities, I have been subjected to harassment, discrimination, and retaliatory actions, particularly during a period of medical treatment and recuperation. These actions have not only led to mental anguish, pain and suffering but also to substantial financial loss and reputational harm.

This pattern of events clearly indicates a disregard for my well-being and rights as a citizen, compounded by the failure of ACRCD to provide a fair and transparent process.

Additionally, my efforts to address the ACRCD board were blocked on two consecutive monthly board meetings, denying me the opportunity to publicly present my concerns. It was only after a last minute revision to the agenda was I able to make a public comment. 

More disturbingly, a CPRA request completed on December 15 revealed indications of possible collusion and conspiracy in decisions related to my tenure at the AgPark. 

Discussions about historic incidents, irrelevant to my current year-to-year contract running from January to December 2023, were apparently used as justification for the non-renewal of my license.

Notably, throughout the 2.5-year tenure of the current Sunol Agpark Manager, I was never informed nor issued a warning that I was failing to comply with the Agpark management plan.

These actions have not only unjustly ended my farming operations but have also led to financial hardship. Significant investments made in equipment, especially during the COVID lockdown to comply with AgPark management requirements, have now become burdensome.

Given these circumstances, I am requesting your office to conduct a thorough investigation into the conduct of ACRCD, a public agency that should uphold the highest standards of fairness and transparency. 

It is imperative that such public entities operate with integrity, particularly when their actions have profound impacts on individuals’ livelihoods and well-being.

Your guidance and support in seeking justice and rectifying the wrongs I have faced would be invaluable. I am prepared to provide all necessary documentation and evidence to facilitate this inquiry.

Concerns Regarding Transparency and Conduct in ACRCD and Sunol AgPark Management

I am writing to express serious concerns about the operations and conduct of the Alameda County Resource Conservation District (ACRCD) and the management of Sunol AgPark, particularly in relation to my farming contract and the treatment I have received.

Through a recent CPRA request, I have uncovered emails that suggest a lack of transparency and potential collusion in the management practices at Sunol AgPark. 


These emails indicate that the Agpark manager and advisory board members have engaged in discussions about me, which reference incidents and issues from previous years, outside the scope of my current year-to-year contract. 


This raises concerns about the use of my past history, which should have no bearing on the current contractual relationship, to negatively impact my farming operation.

Moreover, it appears that the Agpark manager has conducted “one on one” meetings with individuals involved in these discussions, without any proper record or minutes being maintained. 


Such practices are concerning as they lack the transparency expected in public entities and are essential for accountability under public records laws. The absence of these records also hinders my ability to understand the full context and content of discussions that have had a direct impact on my livelihood.

Given these circumstances, I am concerned that there may be violations of public records laws, ethical misconduct, and possibly collusion and conspiracy against me. 


This situation not only affects my ability to operate my farm but also raises broader questions about the integrity of ACRCD and Sunol AgPark management.

In particular, the following legal and ethical categories of concern have arisen from my findings:

- Lack of Transparency: Non-disclosure of meeting records and interactions related to my farming operation, raising questions about transparency in official business.

- Violation of Public Records Laws: Potential non-compliance with the California Public Records Act (CPRA) due to failure to properly document and disclose official meetings and communications upon request.

- Improper Conduct and Ethical Violations: Conducting undocumented "one on one" meetings by the Agpark manager, potentially violating ethical standards expected in public administration.

- Collusion and Conspiracy: Indications of coordinated efforts between the Agpark manager and advisory board members, targeting me based on non-current contractual matters.

- Discrimination/Retaliatory Behavior: Use of historical issues, not pertinent to the present contract, in decision-making, possibly leading to discriminatory or retaliatory actions against me.

These issues collectively suggest a pattern of conduct that undermines the principles of fairness, accountability, and legal compliance, essential in public sector operations.

I respectfully request that your office investigates these matters to ensure that proper procedures and ethical standards are being upheld. It is imperative that public entities like ACRCD conduct their operations in a transparent, fair, and lawful manner.

Concern Regarding Unilateral Modification of Farm Policy by ACRCD

I am writing to bring to your attention a matter of grave concern related to my experience with the Alameda County Resource Conservation District (ACRCD) and my farming operation at Sunol AgPark.

Upon reviewing the farm policy for the year 2023, which I duly signed, I discovered that it explicitly granted me the right to mediation in the event of disputes. 

However, it has come to my attention that during the course of a dispute resolution process, the wording of this policy was altered in a manner that effectively eliminated my right to mediation. 

This alteration was made without my consent or notification, leading me to believe it constitutes a case of unilateral contract modification.

The modification of the agreed-upon terms of the farm policy, particularly after my acceptance of the original terms, raises serious legal and ethical concerns. 

I have reason to believe this action was not a mere oversight but potentially carried out with intentional malice, aimed at denying me the fair opportunity to resolve disputes through mediation as initially promised.

This situation not only undermines my trust in the operations and governance of ACRCD but also appears to violate basic principles of contractual agreements. 

Such unilateral modifications without the consent of all involved parties are generally not permissible under contract law.

I respectfully request your office to look into this matter, as it not only affects my farming operation but could also have broader implications for the integrity of contractual agreements overseen by public agencies like ACRCD. Ensuring that such agencies adhere to legal and ethical standards in their dealings is crucial for maintaining public trust and the fair treatment of individuals they engage with.

My name is Lalitha Visveswaran , and I have been a dedicated farmer at Sunol AgPark for the past ten years. 

Today, I am here to bring to public attention a matter that not only marks the end of my decade-long farming career but also raises serious concerns about the practices and policies of the Alameda County Resource Conservation District (ACRCD) and Sunol Agpark management.

Recently, my license to farm at the AgPark was not renewed, a decision that has been deeply troubling and, I believe, unjust. 

The reasons cited for this non-renewal are rooted in what I have experienced as clear instances of harassment and discrimination. 

Throughout this ordeal, I have repeatedly sought to engage with the ACRCD and Sunol Agpark management to address these issues, yet my efforts have been met with silence.

As a solo female farmer, the challenges I have faced at the AgPark go beyond the usual rigors of agricultural work. My experiences have been marked by treatment that I can only describe as discriminatory and dismissive. 

Despite my commitment and contributions to the AgPark over the last decade, I have been given a mere two months to dismantle my operation and leave – a decision that effectively terminates my farming career without due consideration or a fair process.

Crucially, at no point during this process was I given the opportunity to present evidence in my defense or engage in mediation, despite multiple requests. 

This lack of due process and the denial of a chance to mediate are not only contrary to the principles of fairness and justice but also reflect poorly on the governance and ethical standards of the ACRCD.

In bringing this to your attention, my goal is not only to seek redress for my situation but also to highlight the need for systemic change within the ACRCD and Sunol Agpark management. 

It is imperative that policies and practices be scrutinized and reformed to ensure they uphold the principles of fairness, equity, and respect for all farmers, regardless of gender or background.

As I prepare to leave the AgPark, it is with a heavy heart but also with the hope that my story will catalyze positive change, preventing others from facing similar hardships. 

I urge the implementation of a process to impartially address and reconcile the alleged violations, ensuring a just resolution that acknowledges the truth of my experiences at Sunol AgPark and the end of my farming career so that no other vulnerable farmer faces the extinguishment of their career.

I urge the board and the management to reflect on these issues and take necessary steps to address them.

This is to bring an urgent update on the retaliatory non renewal of my farming license that remains unaddressed and I write to you to seek justice and fair treatment from the Alameda County Board of Supervisors regarding the termination of my farming operations at Sunol Ag Park under conditions of prejudice, harassment and retaliation.

For over a decade, I have been a dedicated and compliant tenant, the only remaining solo female farmer managing my enterprise while adhering to all regulations.

Despite my commitment, following the notice I provided of my medical recuperation post-surgery, I faced escalating harassment and fabricated charges by ACRCD and Sunol Ag Park management, leading to the unjust termination of my operations.

This harassment, which constitutes a claim of tortious interference with contract, began conspicuously after I informed them of my surgery and recovery period.

As an illustrative example of harassment and prejudice, enclosed are two images: one showing my open shed within my allocated area, and another revealing the more extensive and unpermitted spread of materials by other farmers in the Ag Park.

It is evident that there is a disparity in treatment; while my operation has been scrutinized and penalized, others have been overlooked or even permitted to operate outside the bounds of their agreements.

This matter extends beyond mere licensing; it is about the principle of equitable treatment under the administration of the Ag Park.

My appeals for mediation, meetings, and fair consideration have been disregarded, causing me undue financial loss, emotional distress, and reputational damage, particularly egregious given my status as a recovering patient.

This is not to request the renewal of my farming license, but to call upon your offices to investigate this matter and to hold accountable those who have acted with prejudice and retaliation.

The termination of my decade long farming career at Sunol Agpark should have been handled with transparency and fairness, and the denial of due process in my case warrants a thorough review.

My aim is to ensure that no other vulnerable farmer suffers such discrimination and that the values of justice and equality are upheld within the governance of Sunol Ag Park, Alameda County and California.

I trust that you will give this matter the serious attention it deserves and take appropriate action to rectify the wrongs that have been done.

I am writing to seek your urgent intervention in a matter that has severely impacted my health, livelihood, and sense of justice. As a long-standing farmer at Sunol AgPark for ten years, managed by the Alameda County Resource Conservation District (ACRCD), I have been subjected to a series of actions that not only disregard fair process but also exacerbate my existing health challenges.

In November 2023, ACRCD decided not to renew my farming license, giving me a mere 5-week notice to vacate and clear a decade-long farming operation. 

This abrupt notice, significantly shorter than the stipulated 2-month requirement, followed my communication to ACRCD about a leave of absence due to medical recovery and a grievance I filed regarding harassmentexperienced during this medical leave. 

The timing of this decision – during the holiday season when logistical support is scarce and weather conditions are adverse – adds to the challenge of this massive undertaking and feels particularly retaliatory.

The timing along with the insensitivity to the practical difficulties of relocating during the holiday season and inclement weather, has placed me under extraordinary pressure. 

It has not only hindered my recovery from an ongoing health condition but also added to the emotional and physical strain I am enduring.

This situation follows a long-standing grievance about harassment at the AgPark, which I feel was not duly addressed by ACRCD. Despite my continuous efforts to meet their demands over the past six months, the abrupt termination of my license feels unjust and punitive

Requests for a moratorium on the decision and for a meeting to discuss these issues have been repeatedly denied, adding another layer of distress to an already challenging situation.

This hasty and inflexible eviction notice, coupled with the refusal to address my grievances, feels retaliatory – a way for ACRCD, a public agency, to obscure its own shortcomings and mishandling of the situation.

I am reaching out to you for assistance in securing immediate relief through:

  • A Moratorium on the Non-Renewal Decision: A temporary freeze on the eviction process, giving me adequate time to recover my health and arrange for the relocation of my farming operation in a manageable manner.

  • A Meeting to Discuss Grievances: Facilitating a meeting with ACRCD to address the handling of my harassment grievance, the non-renewal process, and the lack of due process and empathy in their actions.

The resolution of this issue is critical not only for my personal well-being but also for upholding the principles of fairness and justice in our community.

Despite facing these significant challenges, I endeavored to comply with the operational standards and requirements to the best of my ability. 

However, I am concerned that my substantial efforts over the six months following the notice of violation have not been duly acknowledged in the non-renewal decision.

Given these circumstances, I request a meeting with ACRCD to discuss a fair assessment of my situation. This meeting should consider:

  • The Circumstances of My Medical Condition: An understanding of the impact of my medical recuperation on my ability to meet farming obligations.

  • Efforts Made Post-Violation Notice:Recognition of the efforts and compliance measures I undertook between the notice of violation and the non-renewal notice.

  • Need for Dialogue: The seriousness of the harassment allegations and my compliance efforts necessitates a comprehensive discussion.

The resolution of this grievance is critical, not for the reinstatement of my license, but for ensuring ACRCD recognize the gravity of this situation and the message that inaction sends to its community and stakeholders. 

This meeting would provide an opportunity for me to present my experiences and evidence related to the harassment, my compliance, and for ACRCD to respond and take appropriate actions. 

Furthermore, the lack of response or resolution to my grievance could be perceived as tacit approval by ACRCD of the alleged behaviors and potentially suggests organizational acceptance of such conduct. 

The failure to address these grievances adequately undermines trust in ACRCD's ability to manage fair and ethical practices. 

A thorough and transparent examination of these issues is crucial, not only for my case but also for upholding the integrity and values of ACRCD as a public agency.

ACRCD dispute resolution letter dated 8.29.2023 stated : [..] If you disagree with the second proposed resolution, you may so notify the ACRCD in writing. The ACRCD may then decide, within 7 days of receipt of the notice, to submit the grievance to non-binding mediation, with the cost of the mediator shared equally by the parties.[..]

If Katherine Boxer declines the option of internal mediation to address the grievance concerning allegations of medical harassment, workplace harassment, and discrimination that have resulted in emotional distress, financial loss, and reputational harm, compounded by retaliatory actions such as non-renewal, it would imply that the Alameda County Resource Conservation District (ACRCD) tacitly supports or condones such behaviors and practices against the licensee.


Consequently, in the absence of internal resolution, I would have no alternative but to seek external intervention and would like to report these issues to the relevant authorities or oversight bodies within Alameda County.


To provide a clear timeline of events:

  • June 7: A violation of my license was issued shortly after I had remedied the field cover crop. This action occurred despite informing the AgPark management of delays due to my medical recuperation.

  • July 24: Demands for compliance, as set forth by the AgPark management, were fully met by me in good faith and within the stipulated time frame.

  • July 27: Despite complying with all demands for the license, I filed a dispute and grievance report due to ongoing harassment and discrimination by the AgPark manager. This grievance was not satisfactorily resolved by ACRCD.

  • Following the Grievance Submission: After communicating my concerns regarding potential retaliation for raising these issues, the response I received was the non-renewal of my license. This action was taken without honoring the mediation process that is a part of due process as per the farm policy. The decision to non-renew, under these circumstances, appears to be both punitive and retaliatory.

This sequence of events indicates a disregard for the established procedures meant to ensure fair and just resolution of grievances. The denial of mediation, in particular, is a critical omission that undermines the integrity of the entire grievance process.


The actions of the Alameda County Resource Conservation District in this matter suggest an attempt to obscure or downplay the severity of the issue, potentially to shield themselves from accountability or adverse consequences. Such an approach gives the impression of prioritizing their own interests over addressing the grievances raised, including those of medical harassment, workplace harassment, discrimination, and the associated impacts.

I am writing to express my concerns following the most recent communication dated Nov 29, 2023 from Katherine Boxer, confirming the finality of the non-renewal of my farming license by ACRCD without addressing the request for mediation.

This decision, in my view, is a blatant attempt to obscure the agency's misdeeds, encompassing a range of issues including harassment during my medical recuperation, ongoing harassment, discrimination, causing financial loss, humiliation, emotional distress, retaliatory action, and reputational harm.

The conduct of ACRCD and the Sunol AgPark management in handling these matters shows a neglect of their duty to ensure a safe and respectful working environment. 

Instead, it appears as a concerted effort to protect the involved employee at my expense. Rather than addressing these allegations of misconduct, the focus seems to have shifted to protecting the wrongdoer through punitively retaliatory measures against me.

Given the gravity of these charges, I am not merely seeking a reevaluation of the non-renewal decision. My request is for a formal mediation meeting to address these allegations thoroughly and seek justice.

Furthermore, my attempts to engage with the ACRCD Board, including Karen Sweet, have been met with a lack of response. Efforts to join the monthly board meeting via Zoom were unsuccessful, and my attempts at communication have been systematically limited.

The denial of opportunities to present my case and evidence, including photographs and witness testimonies, is indicative of a deliberate effort to avoid addressing these matters appropriately. 

Additionally, my request for public records under the California Public Records Act (CPRA) related to AgPark remains unanswered.

I am seeking your intervention to ensure that these charges are taken seriously and that justice is served in the face of these apparent attempts to cover up the agency's alleged misdeeds. A fair, transparent, and comprehensive process is crucial to address these issues.

I request an opportunity to address the Board of ACRCD to discuss Ms. Katherine Boxer's retaliatory conduct in denying a mediation or a meeting to discuss the harassment, discrimination, gender bias, finanacial loss, emotional distress, reputational harm caused by ACRCD and Sunol Agpark Management. The harassment follows the period of my recuperation after surgery in May 2023 and despite the impediments to recovery, I had diligently complied with all the demands and requirements set forth by the Agpark Manager. 

My license to farm at the Sunol Agpark was denied despite my best efforts towards the completion of all the tasks on Nov 7, 2023. A request for a fair and amicable resolution through mediation that I am entitled to according to the farm policy and presentation of evidence was outright denied and resulted in retalitation. I am appealing to the Board of ACRCD to review this matter in a fair and impartial manner. Thank you for your time and attention to this urgent matter.

I am writing to seek your urgent intervention in a matter that has significantly impacted my livelihood and well-being. I am the sole farmer/operator of Jellicles Farm at Sunol Agpark for the past ten years.

I have recently been subjected to a series of actions by the AgPark management that I believe are unfair and retaliatory in nature.

The Sunol AgPark is owned by the San Francisco Public Utilities Commission (SFPUC) and managed through a partnership agreement with the Alameda County Resource Conservation District (ACRCD).

In June 2023, during a period of medical recuperation following surgery, I began experiencing harassment and discrimination at the AgPark.

This period was marked by continual targeted harassment and discrimination to fulfill a series of articulated demands under a very tight timeline with threats of non-renewal.

The stress and emotional toll of this harassment significantly impeded my recovery and ability to effectively manage my farming operations.

Despite these challenges, I have diligently complied with all demands and requirements set forth by the AgPark manager.

However, in a move that I perceive as retaliatory by Katherine Boxer, Chief Executive Officer ACRCD, my license was non-renewed after six months of diligent obedience to all the imposed conditions, threatening the very existence and future of my farming operation.

Furthermore, my attempts to seek a fair and amicable resolution through mediation were outright denied. This denial came particularly concerning after I expressed fears of retaliation for raising issues of harassment and discrimination.

The lack of any mediation process that I am entitled to in the farm policy has not only been a denial of due process but has also exacerbated the emotional distress I have been experiencing.

I am therefore appealing to the Board of Supervisors to review this matter. My request is for a fair and impartial assessment of the actions taken against me, reinstatement of my farming license, and the facilitation of a mediation process to resolve these ongoing issues in a constructive and fair manner.

I am prepared to provide any additional information or documentation needed for this review. I trust that the Board will consider my case with the seriousness it deserves and help in restoring fairness and justice to my situation.
